Marie Fleming – The Supreme Court’s judgment.

The Supreme Court in the Republic of Ireland has delivered its judgment on the case of Marie Fleming.

Marie Fleming has lost her appeal to the Supreme Court in Ireland against a ruling of the High Court in January this year.

Here is the Supreme Court’s Judgment, delivered on 29th April 2013.

The High Court had ruled that Section 2(2) of the 1993 Criminal Law (Suicide) Act was not unconstitutional or incompatible with the State’s obligations under the European Convention on Human Rights.  Under Section 2(2) it is unlawful in Ireland to ‘aid, abet counsel or procure’ the suicide or attempted suicide of another person.  Section 2(2) is similar to Section 2(1) of the 1961 Suicide Act in England and Wales.
